 National Arbitration

For arbitrations in which both parties have their seat in Switzerland, Supplementariy Rules for the application of the Swiss Rules of International Arbitration for domestic arbitrations came into effect on January 1st, 2011. You can download them here.

Swiss Rules of International Arbitration

The Chambers of Commerce in Basel, Berne, Geneva, Lausanne. Lugano, Neuchâtel and Zurich offer international arbitration under the Swiss Rules of International Arbitration. More information on www.swissarbitration.org

Autonomy of the parties

The Swiss Rules of International Arbitation give a lot of autonomy to the parties in establishing procedures and the choice of arbitrators. The parties can thus influence the cost and the duration of the proceedings.

Seat of Arbitration

The seat of arbitration is Basel, unless the parties decide for another city in Switzerland or abroad. Meetings can be held anywhere the parties choose.

Fast-Track

When the amount in dispute is below 1 million Swiss Francs, and in all other arbitrations where the parties so agree, a fast-track procedure with short delays and accelerated procedurs will apply.

Initiating arbitration

A Notice of Arbitration has to be submitted to the Basel Chamber of Commerce, Aeschenvorstadt 67, CH-4010 Basel, Switzerland in as many copies as there are other parties, together with an additional copy for each arbitrator and the Chamber.
